RELEASE OF LIABILITY & WAIVER AGREEMENT
Release of Liability & Waiver
Thank you for participating in a creative experience provided by Haven Art Studio LLC ("Haven").
Haven creates memorable art experiences designed to inspire creativity, connection, and self-expression. These experiences may take place at client-selected locations, including homes, businesses, restaurants, breweries, schools, community spaces, and other approved venues.
By participating in any Haven Art Studio LLC experience, all participants and/or legal guardians acknowledge and agree to the following terms.
1. Assumption of Risk
Participants understand that creative activities may involve certain risks, including but not limited to the use of art supplies, tools, materials, movement within the event space, accidental spills, and interactions with other participants.
By participating, each attendee voluntarily assumes all risks associated with the activity and agrees to follow all safety instructions provided by Haven instructors and staff.
These risks may include, but are not limited to:

Slips, trips, and falls

Exposure to paint, art supplies, sensory materials, adhesives, cleaning products, or other studio materials

Allergic reactions, respiratory irritation, or skin sensitivities

Minor cuts, bruises, burns, or physical injuries

Damage to clothing or personal property

Injuries arising from movement-based, interactive, or group activities

Risks associated with paint-throwing or sensory experiences
I voluntarily choose to participate and knowingly and freely assume all risks, known or unknown, associated with participation in any Haven Art Studio activity.
2. Release of Liability
To the fullest extent permitted by the laws of the State of Florida, participants release and hold harmless Haven Art Studio LLC, its owners, employees, instructors, assistants, independent contractors, volunteers, and event partners from any claims, liabilities, damages, injuries, losses, or expenses arising from participation in Haven activities.
This release applies to ordinary risks associated with participation in creative experiences.
Nothing in this agreement limits liability for gross negligence, intentional misconduct, or any responsibility that cannot legally be excluded under applicable law.
3. Participant Responsibility
Participants are responsible for their own safety and personal belongings during the experience.
Participants agree to follow all instructions provided by Haven staff and to use materials responsibly.
Haven reserves the right to remove any participant from an activity if their behavior creates a safety concern, disrupts the experience, or places others at risk.
No refunds or compensation will be provided for participants removed due to unsafe or inappropriate behavior.
4. Minors & Children’s Activities
For participants under the age of 18, a parent or legal guardian must acknowledge and accept this waiver on behalf of the minor.
Parents and guardians remain responsible for supervising children when required and ensuring that participants follow all safety instructions throughout the experience.
5. Venue Conditions & Property
Haven provides creative materials and instruction but does not control the conditions of client-selected venues.
Participants and event hosts are responsible for protecting personal property and following any venue-specific rules.
Haven is not responsible for loss, theft, or damage to personal belongings or property resulting from participant actions, venue conditions, or circumstances outside Haven’s reasonable control.
6. Photography & Media Release
Participants acknowledge that Haven may photograph or record portions of creative experiences for promotional, educational, and marketing purposes, including use on Haven’s website, social media platforms, advertisements, and other promotional materials.
If a participant does not wish to appear in photographs or videos, they may notify Haven before the event begins. Reasonable efforts will be made to respect that request.
7. Medical Emergencies
Participants authorize Haven staff to seek reasonable emergency assistance if an injury or medical situation occurs during an experience when immediate action is necessary.
Participants understand that Haven staff are not medical professionals and are not responsible for providing medical treatment beyond reasonable assistance.
8. Acknowledgment & Agreement
By participating in a Haven Art Studio LLC experience, participants acknowledge that they have read, understood, and voluntarily agree to this Release of Liability & Waiver.
Participants understand that this agreement is intended to protect both the participant and Haven while allowing everyone to enjoy a safe, creative, and memorable experience.
9. Governing Law
This Release of Liability & Waiver shall be governed by the laws of the State of Florida.
10. Electronic Signature & Acknowledgment
By signing electronically or physically, I acknowledge that I have carefully read this Release of Liability & Waiver Agreement, fully understand its contents, and voluntarily agree to its terms.
I understand that by signing this Agreement, I am giving up certain legal rights, including the right to sue.
