RELEASE OF LIABILITY & WAIVER AGREEMENT

Haven Art Studio

By participating in activities hosted by Haven Art Studio, including but not limited to painting classes, sensory activities, workshops, camps, private events, paint-throwing experiences, use of art materials, studio rentals, and recreational or creative activities, the participant (or parent/legal guardian of a minor participant) acknowledges and agrees to the following:

1. Assumption of Risk

I understand and acknowledge that participation in creative, recreational, and art-related activities involves inherent risks that may result in bodily injury, illness, allergic reactions, emotional distress, property damage, or other losses.

These risks may include, but are not limited to:

  • Slips, trips, and falls

  • Exposure to paint, art supplies, sensory materials, adhesives, cleaning products, or other studio materials

  • Allergic reactions, respiratory irritation, or skin sensitivities

  • Minor cuts, bruises, burns, or physical injuries

  • Damage to clothing or personal property

  • Injuries arising from movement-based, interactive, or group activities

  • Risks associated with paint-throwing or sensory experiences

I voluntarily choose to participate and knowingly and freely assume all risks, known or unknown, associated with participation in any Haven Art Studio activity.

2. Release of Liability

To the fullest extent permitted under applicable law, I hereby release, waive, discharge, and covenant not to sue Haven Art Studio, including its owners, officers, employees, instructors, contractors, volunteers, affiliates, agents, representatives, landlords, and assigns (collectively referred to as the “Released Parties”), from any and all claims, liabilities, demands, actions, damages, costs, expenses, or causes of action arising out of or related to any injury, illness, death, loss, or property damage sustained while participating in studio activities or while on studio premises, whether caused by negligence or otherwise.

I understand that this waiver includes any claims based on ordinary negligence of the Released Parties.

This release is intended to be as broad and inclusive as permitted under the laws of the State of Florida.

3. Compliance with Florida Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida.

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Any legal action arising under this Agreement shall be brought exclusively in the courts located in Santa Rosa County, Florida.

4. Minor Child Waiver (Florida)

If signing on behalf of a minor participant, I acknowledge and agree that pursuant to Florida Statute §744.301, I am waiving and releasing certain legal rights on behalf of the minor child, including the right to bring certain claims for ordinary negligence.

I certify that I am the parent or legal guardian of the minor participant and that I have full legal authority to execute this Agreement on the child’s behalf.

5. Medical Authorization

In the event of an accident, injury, or medical emergency, I authorize Haven Art Studio staff to obtain emergency medical care deemed reasonably necessary for myself or the minor participant.

I understand that Haven Art Studio does not provide health or accident insurance and that I am solely responsible for any medical expenses incurred.

6. Personal Property

I understand that Haven Art Studio is not responsible for lost, stolen, or damaged personal belongings, including but not limited to:

  • Clothing

  • Shoes

  • Jewelry

  • Phones or electronic devices

  • Bags or personal items

  • Vehicles or vehicle contents

I acknowledge that paints, inks, dyes, and other art materials may permanently stain or damage fabrics, surfaces, and personal property.

Participants are encouraged to wear appropriate clothing for art activities.

7. Photo & Media Release

I grant Haven Art Studio permission to photograph, record, or capture video/audio content during participation in studio activities.

I understand that such media may be used for promotional, educational, advertising, website, print, or social media purposes without compensation or additional approval.

If I do not wish to appear in photographs or recordings, I agree to notify Haven Art Studio in writing prior to participation.

8. Participant Conduct & Safety

Participants agree to follow all studio policies, posted rules, safety procedures, and staff instructions.

Haven Art Studio reserves the right to refuse participation or remove any participant engaging in unsafe, destructive, threatening, inappropriate, or disruptive behavior without refund.

9. Electronic Signature & Acknowledgment

By signing electronically or physically, I acknowledge that I have carefully read this Release of Liability & Waiver Agreement, fully understand its contents, and voluntarily agree to its terms.

I understand that by signing this Agreement, I am giving up certain legal rights, including the right to sue.
